BITRISE ACCEPTABLE USE POLICY


Effective date: October 4, 2021

Section 1: Customers

1.1 Overview. This Acceptable Use Policy (“AUP”) sets out a set of additional terms under which the Customer may access and use the Website and the Services. Capitalized terms shall have the same meaning as defined in the Terms of Service available at the following link: https://www.bitrise.io/terms or such other link as Bitrise may provide for its Terms of Service (the “ToS”). Nothing in this AUP shall be deemed to expand the scope of the license set forth in the ToS. In the event of any conflict between the provisions of this AUP and the ToS, the ToS shall govern.

1.2 Respecting the law. The Customer may use the Website and the Services for lawful purposes only. The Customer may not use the Website and the Services in any way that breaches any applicable local, national or international laws, regulations, and codes. The Customer may not use the Website and the Services in any way that is unlawful, fraudulent, or has any unlawful or fraudulent purpose or effect.

1.3 Respecting intellectual property. The Customer may not attempt to copy, reproduce, duplicate, modify, create derivative works from or distribute all or any portion of the Website and the Services (including any functions, graphics, features, ideas). The Customer may not modify the paper or digital copies of any materials the Customer has printed off or downloaded in any way, and the Customer may not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text. The Customer may not remove any ownership, authorship, or brand notices on the Website and the Services, and the Customer must always indicate such authorship and brands.

1.4 No competitors. The Customer may not access all or any part of the Website and the Services in order to build a website, a product or service which competes with the Website and/or the Services. The Customer is specifically not allowed to use the Website and the Services to create a competitor or facilitate the design of any or all of a competitor service. 

1.5 Security. The Customer may not interfere with, damage or disrupt any part of the Website and the Services or any software used in the provision of the Website and the Services, or any equipment or network on which the Website or the Services are stored. The Customer may not attempt to gain unauthorized access or assist third parties in obtaining unauthorized access to the Website and Services, the server on which the Website or the Services are stored or any server, computer or database connected to the Website and the Services. The Customer may not defeat, avoid, bypass, remove, deactivate, or otherwise circumvent any software protection or monitoring mechanisms of the Website and the Services, the server on which the Website and the Services are stored or any server, computer or database connected to the Website and the Services. The Customer must not attack the Website or the Services via brute-force attacks, a denial-of-service attack or a distributed denial-of service attack. The Customer may not attempt to undertake any security testing of the Website and the Services without the prior written consent of Bitrise.

1.6 No crypto-mining, or other malicious use of the Services. The Customer may not attempt to use the Website and/or the Services (or any portion thereof) to undertake the mining of cryptocurrencies, or to perform any other resource intensive tasks not related to the purpose of the Services (e.g. to use the Website or the Services for denial of service attacks, web scraping, brute-forcing web applications online, brute-forcing or cracking password hashes offline etc.). 

1.7 No reverse engineering. Outside the extent it is allowed by applicable laws, the Customer may not reverse engineer, or attempt to reverse engineer decompile, hack, disable, interfere with, disassemble, modify, copy, translate, or disrupt the features, functionality, integrity, or performance of the Website and the Services. 

1.8 No scraping. The Customer may not access, search the Website and the Services by any means other than our publicly supported interfaces (e.g. via web scraping or web crawling). 

1.9 No spam. The Customer may not use the Website and the Services to transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation.

1.10 No viruses. The Customer may not use the Website and the Services to knowingly transmit or introduce any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs, materials or similar computer code designed to adversely affect the operation of any computer software or hardware.

1.11 No commercial distribution. The Customer may not use the Website and the Services for distributing its applications for purposes other than for internal testing (including, for instance, quality assurance) purposes. In no event shall any distribution be for general use. 

1.12 Conformance with app store rules. Any apps built using all or any part of the Services must at all times fully comply with the current rules for developer submission of such apps to the Apple app store (for iOS apps) and the Google Play store (for Android apps).

1.13 Third parties. The Customer may not authorize, permit, enable, induce or encourage any third party to perform any activities regarding the Website and the Services that are in breach of this AUP.

1.14 Minors. The Customer may not use the Website and the Services for the purpose of harming or attempting to harm minors (or any other person(s)) in any way.

1.15 No consumers. The Customer may not use the Website and the Services for consumer purposes, as the Website and the Services are intended for use by businesses and organizations.

1.16 Content Guidelines:

1.16.1 These content guidelines apply to any and all material which the Customer contributes to the Website and/or the Services of Bitrise including to any interactive service. Contributing materials includes (but is not limited to) sending, knowingly receiving, uploading, downloading, using or re-using, storing, distributing, transmitting materials.

1.16.2 The Customer must comply with the spirit and the letter of this AUP, which apply to each part of any contribution as well as to its whole.

1.16.3 Contributions must be accurate (where they state facts), genuinely held (where they state opinions), and comply with applicable laws.

1.16.4 Contributions must not: (i) contain any material which is defamatory of any person; (ii) contain any material which is unlawful, obscene, offensive, hateful or inflammatory; (iii) promote sexually explicit material; (iv) promote violence; (v) promote discrimination based on race, sex, religion, nationality, disability, sexual orientation or age or is racially or ethnically offensive; (vi) infringe any copyright, database right, trade mark or any other right of any other person or Bitrise; (vii) be likely to deceive any person; (viii) be in breach of any legal duty owed to a third party, such as a contractual duty or a duty of confidence; (ix) promote any illegal activity; (x) be harmful, threatening, abuse or invade another person’s privacy, or cause annoyance, inconvenience or needless anxiety; (xi) be likely to harass, upset, embarrass, alarm or annoy any other person; (xii) be used to impersonate any person, or to misrepresent your identity or affiliation with any person; (xiii) give the impression that they emanate from us, if this is not the case;  (xiv) advocate, promote or assist any unlawful act such as (by way of example only) copyright infringement or computer misuse; or (xv) violate this AUP.

Section 2: Website Visitors

2.1 If anyone accesses the Website but does not become a Customer (i.e., does not create an account), such persons (i.e., Website Visitors) shall comply with this AUP accordingly with regards their use of the Website.

Section 3: Changes to this AUP

3.1 Bitrise may revise this AUP at any time by amending this page. Please check this page from time to time to take notice of any changes.
